Terms of Service

A membership grants the subscribing organization a non-exclusive, non-transferable license to view one product, in-network rates or out-of-network allowed amounts and charges, for the states named in that membership, for the membership term. Access is for the organization's own internal business use by its employees and contractors. It does not include an API, a data feed, or any right to redistribute.

The Service presents distributions computed from files that health plans and repricing vendors publish under the federal Transparency in Coverage rule, and from the NPPES registry. We do not create the underlying figures and cannot verify them. Coverage varies by state and payer and is described on the pricing page before purchase. Facility and payer counts are our best estimates from those files. We work to keep the data accurate and complete, but the source files and our processing can contain duplicates and other errors, and a facility can appear more or fewer times than it exists. We correct errors as soon as we find them. Counts shown before purchase describe the current month's data and are not a warranty of what you will find.

Nothing on the Service is a recommendation of a rate, a charge, a payer, a payment to accept or reject, or a patient to admit. Every figure is a description of published data with its sample size. You are solely responsible for any decision you make, and you agree not to rely on the Service as the basis for a contract, a charge, or a clinical or admission decision.

The Service and the data are provided as is and as available, without warranty of any kind, express or implied, including accuracy, completeness, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential, special or punitive damages, or for lost revenue or profits, arising from the Service. Our total liability for any claim is limited to the fees you paid us in the twelve months before the claim arose.

You will defend and indemnify us against claims arising from your use of the Service in breach of these terms or in violation of law.

You will not scrape, crawl, bulk-download, or systematically extract data from the Service; share credentials outside your organization; republish figures from the Service as a dataset; or use the Service to build a competing product. Figures from the Service are for your organization’s own use. You will not forward, post, or otherwise share screenshots, printouts, or figures from the Service with anyone outside your organization. We may suspend or terminate access for breach, without refund.

Memberships are annual and prepaid, per product. Your state selection is set for the term. There are no refunds. Memberships renew for a further year at the then-current price unless cancelled before the renewal date; the cross-product discount applies at renewal only while the other membership is active.

Amounts, facilities and notes you enter are yours. We use them only to render your views and never publish them.

We may update these terms on notice by email or on the Service. Continued use after the effective date of a change is acceptance.

Delaware law governs, without regard to conflict-of-laws rules. Disputes are heard in the state or federal courts located in Delaware.
